Contrary to many beliefs, Pharma contracts/actions could be challenged if fraud was proven--not easy but a vehicle to litigate. Pushing it up into the world of "national security/terrorist/war" considerations kills the fraud argument. Try getting the govt to define/id exactly what was the national security. 🤔🙄

That's simple: They were all scared out of their wits and offered what appeared to be a 'lifeline'. That, probably coupled with the threat of being 'left behind' in the face of a public clamouring for a product that their leaders could be made to appear to have fumbled the acquisition of was likely all it took.

Just because the federal government, congress or the administrative agency enacts a law, that is no the end of the analysis. I leave it to the class action plaintiff's lawyer and constitutional scholars to address this in the courts in the near future. As a 30 year commercial transaction attorney, this all seems suspect to me.
