"Either Tribe did not read the decision, or his ideology blinded him from reality."

Eh... you left out an option there.

He read it and simply lied about what it says because he knows that 99.99% of the public will not read it.

Yes. The most likely option.

The series of events which led to the creation of the US constitution was very rare historically. A once in a millenium group of individuals got together and tried to put something together that was as resilient as possible against the ugly sides of human nature. Well human nature has not changed. It doesn't matter how many educational degrees you have. The VAST majority of explanations for why people behave the way they do are rationalizations, no matter how erudite they sound, or how much jargon they use, The core motivators are vested interests, which most people are blind to, particularly in themselves. The lawyer you mention has the perfect name Tribe because that is what he epitomizes. He has picked his "tribe" and he will agree with them no matter what the issue, and then rationalize an explanation. If suddenly Trump or some other populist were elected and promoted all the same censorship actions that are being done now, but directed at Tribe's "tribe", then Tribe would turn on a dime and begin vehemently defending the first amendment.

There is a simple test to the genuineness of Tribe's intentions - protecting Americans and democracy: would he advocate for the same Presidential Administration powers over determined misinformation for a Trump, or, RFK Jnr Presidency? I doubt anyone would have the gall to argue he would - though I am being constantly surprised by how far the limits of sense and nonsense are being pushed.

Good stuff, Jeffrey Tucker, Brownstone!

How about that Justice Oliver Wendell "Three generations of imbeciles is enough" Holmes Buck v Bell eugenicist! Loved him some sterilizations of undesirables and mentally ill - no doubt he'd support "gender-affirming care" sterilization surgeries and chemical cocktails of the mentally ill who get them! And the "reproductive care" of eugenicist Sanger's Planned Parenthood's mostly located in the inner city 'hoods aborting those poor racially inferior imbeciles! (not my beliefs, the beliefs of the eugenicists pushing for the sterilizing and aborting)

But you know who's even more dangerous than Harvard law professor Larry Tribe? Harvard law professor Cass Sunstein. Cass Sunstein is busy writing legal papers today for lawyers and judges to rely on about how to reinterpret the US Constitution to accommodate "The Science of Totalitarianism." Also known as Behavioral Science. "Freedom is Slavery"-level linguistics applied to a "living, breathing constitution":

How to Interpret the Constitution, Cass Sunstein, August 15, 2023 (release)

https://www.kirkusreviews.com/book-reviews/cass-r-sunstein/how-to-interpret-the-constitution/

The Rule of Law, Cass Sunstein, Harvard Law School, March 30, 2023,

https://papers.ssrn.com/sol3/papers.cfm?abstract_id=4405238

Following this Behavioral Science in interpreting the US Constitution is how the US Constituion becomes a weapon of oppression against individual liberty and freedom. Turns a document written to restrain government into a document that restrains citizens. The rights of an authority-declared "collective good" held up as a constitutional right superior to individual rights. The Praetorian Guard's ultimate revenge.

Great synopsis of the Orwellian censorship empire for which it seems has captured the mindshare of much of society. At each step of the way as we tumble deeper the mass simply accepts whatever dystopia that has been revealed as the new normal.

I made reference to this article supporting my latest philosophical post on the relationship one must have with all media/information is default distrust.

Sigh...

The tactics employed are very simple iterations of ordinary salesmanship. Substitute x product for the subjects referred to in your above report, and anyone familiar with sales techniques and organizations will recognize the tactics immediately.

The average person, being unfamiliar with the myriad ways he's been convinced to part with his money, is vastly under-prepared to marshal the indomitability required to force factual utterances from the mouths of those engaging in deceit.

Well, if censorship of protected free speech isn't happening, an injunction against it shouldn't be a problem then...
